Agentic AI (0): What It Is, Why It Changes Compliance Evidence, and What This Series Will Cover

Autonomous AI agents don't just answer questions — they take actions. That distinction rewrites your entire compliance evidence strategy.

A Conversation at a Kingston Coffee Shop

Last month I sat down with the owner of a mid-sized manufacturing firm in Kingston. He told me, with genuine pride, that his team had "adopted AI." When I asked what that meant in practice, he described a ChatGPT window his office manager kept open to draft customer emails and summarize meeting notes. That is a perfectly reasonable use of a large language model. It is also not what keeps me up at night.

What keeps me up at night is the next step — the step a growing number of Hudson Valley businesses are already taking or will take within the next twelve months. It is the shift from asking an AI a question to letting an AI do things on your behalf. Schedule meetings. Query your customer database. File support tickets. Pull financial records. Send communications. Make purchasing decisions based on predefined rules. That shift has a name: agentic AI. And it changes the compliance landscape in ways that most business owners, and frankly most IT professionals, have not yet internalized.

This post is the starting point for a new series. Every compliance framework we have covered on this blog — from NIST CSF and CIS Controls to HIPAA, PCI DSS, and SOC 2 — will need to be re-examined through the lens of agentic AI. Before we get into the framework-specific details in future installments, we need to establish shared vocabulary and shared understanding of the problem. That is what this post is for.

What Makes Agentic AI Different

A conventional chatbot interaction is stateless and passive. You type a prompt, the model generates a response, and the conversation ends there. The model has no access to your systems, no ability to take actions, and no memory of what happened last Tuesday. It is a sophisticated text generator, and the compliance considerations are relatively contained: data privacy for what you paste into the prompt, intellectual property concerns, and maybe some accuracy questions around the output.

Agentic AI operates on a fundamentally different model. An AI agent is a system that can autonomously plan and execute multi-step tasks, use external tools, access persistent memory, and make decisions without waiting for human approval at every step. Consider the difference between asking ChatGPT "What should I order for the office?" and deploying an agent that monitors your supply closet inventory, compares vendor prices, places orders when stock drops below a threshold, and updates your accounting system — all without a human in the loop.

The four defining characteristics of agentic AI:

1. Autonomous decision-making — the agent determines its own next steps based on goals, not direct commands.
2. Tool use — the agent can call APIs, query databases, read and write files, send emails, and interact with external systems.
3. Multi-step workflows — the agent chains together sequences of actions to accomplish complex objectives.
4. Persistent memory — the agent retains context across sessions, learning from prior interactions and outcomes.

Each of those characteristics introduces compliance obligations that did not exist when your staff was simply copy-pasting text from a chatbot window. Let me walk through why.

New Risk Categories That Demand New Evidence

Data Exfiltration Through Agent Actions

When an agent has permission to read your customer database and also has permission to send emails or call external APIs, you have created a pathway for data exfiltration that no traditional access control was designed to handle. The agent is not a malicious insider — it is a piece of software following instructions that may be subtly wrong, manipulated through prompt injection, or simply too broad. A purchasing agent that can read supplier contracts and also post to a Slack channel could inadvertently expose pricing terms you negotiated under NDA. The risk is not theoretical. It is architectural.

Model Drift and Behavioral Unpredictability

The large language models powering agentic systems get updated by their providers. OpenAI, Anthropic, Google, and others push model changes that can alter how an agent interprets instructions, prioritizes tasks, or handles edge cases. Your agent that reliably followed your refund policy last quarter may interpret it differently after a model update you did not even know occurred. For businesses in the Hudson Valley operating under regulatory requirements — healthcare practices bound by HIPAA, financial advisors under SEC rules, manufacturers with ITAR obligations — this kind of behavioral drift is not an inconvenience. It is a compliance event.

Unauthorized Tool Access

Agents operate by calling tools, and the permissions you grant determine the blast radius of any failure. If your agent has read-write access to your EHR system when it only needs read access to appointment schedules, you have violated the principle of least privilege in a way that would show up in any competent audit. The problem is compounded by the fact that many agentic frameworks default to broad permissions because that is easier for developers, and many business owners deploying these systems do not realize what access they have granted until something goes wrong.

Audit Trail Gaps

This is the one that matters most for compliance evidence. When a human employee accesses a patient record, your EHR system logs the access with a timestamp, user ID, and the record viewed. When an AI agent accesses that same record as one step in a fifteen-step workflow, what gets logged? In many current implementations, the answer is disturbingly little. The agent's internal reasoning, the sequence of tool calls, the data it read and the data it chose to act on — all of that can vanish into an unlogged void. For any compliance framework that requires demonstrable access controls and audit trails, this is a showstopper.

Accountability Gaps

Here is the question that boards, regulators, and auditors are going to ask with increasing frequency: who decided? When an agent approves a transaction, modifies a record, or sends a communication, the traditional chain of accountability — employee made a decision, manager approved it, system logged it — breaks down. The employee set up the agent. The developer built the workflow. The model provider trained the underlying model. The agent made the specific decision. Compliance frameworks require clear accountability for actions taken on regulated data, and the agentic model distributes that accountability across multiple parties in ways that existing policies do not address.

Why Existing Frameworks Were Not Built for This

Take a look at any compliance framework you are currently operating under. NIST CSF organizes controls around identifying, protecting, detecting, responding to, and recovering from cybersecurity events. CIS Controls prescribe specific technical safeguards. HIPAA mandates administrative, physical, and technical safeguards for protected health information. PCI DSS requires controls around cardholder data environments. SOC 2 evaluates trust service criteria.

Every one of these frameworks was designed around a model where humans use technology as a tool. The human decides, the technology executes, and the compliance evidence demonstrates that appropriate controls were in place around that human-technology interaction. Agentic AI inverts that model. The technology decides, the technology executes, and the human may not even be aware of the specific action until after it has occurred — if they become aware at all.

This does not mean these frameworks are obsolete. It means they need an additional layer of interpretation and implementation that accounts for autonomous software actors. The NIST AI Risk Management Framework is a good starting point — it explicitly addresses AI-specific risks including transparency, accountability, and governance. The CISA Cybersecurity Performance Goals provide baseline expectations that can be extended to cover agentic systems. But neither of these, nor any existing framework, provides a turnkey compliance program for businesses deploying AI agents. That gap is what this series aims to help fill.

What Your Logging and Evidence Requirements Look Like Now

If you are deploying or planning to deploy agentic AI in any capacity that touches regulated data, customer information, financial records, or critical business processes, your evidence requirements have expanded. Here is what an auditor will expect to see — and what you should be collecting from day one.

Every agent action must be logged with a timestamp, the initiating trigger (human request, scheduled task, or autonomous decision), the tool or API called, the data accessed, the data modified, the outcome, and any error conditions. The agent's reasoning chain — why it chose action A over action B — must be captured and retained. Human override and approval events must be logged separately from autonomous actions. Permission grants and changes to agent tool access must be tracked with the same rigor you apply to human user access management.

This is not aspirational. This is the minimum evidentiary standard that aligns with the intent of existing frameworks when applied to autonomous systems. If you cannot produce this evidence for an auditor, you have a gap — and it is a gap that grows more consequential with every additional agent you deploy.

Evidence Pack: Agentic AI Compliance Baseline

The table below outlines the foundational evidence artifacts you should begin assembling now. Future posts in this series will expand on each item with framework-specific detail.

What This Series Will Cover

This post is the foundation. In the installments that follow, we will take each major compliance framework and examine it through the agentic AI lens. That means revisiting the control families, identifying where agent-specific obligations arise, and building out the evidence packs you will need to demonstrate compliance when autonomous systems are part of your environment.

Here is the roadmap. NIST AI RMF will be first, because it provides the most direct guidance for AI governance and maps well to the other frameworks. Then we will work through NIST CSF 2.0, CIS Controls v8, HIPAA, PCI DSS 4.0, and SOC 2 — each with specific attention to how agentic AI changes the control implementation and evidence requirements. We will also address New York State-specific considerations, including the SHIELD Act and DFS cybersecurity regulation, because a substantial number of Hudson Valley businesses operate under those requirements.

Each post will follow the same structure you are used to on this blog: a local hook to ground the discussion, plain-language explanation of the obligations, an implementation plan you can act on, and an evidence pack table you can hand to your compliance team or your auditor.

First, inventory every agent and every tool permission it holds. Second, confirm that you have logging in place that captures agent actions at the same fidelity you require for human user actions. Third, add agentic AI as a line item in your risk register, even if the entry is preliminary. Those three steps will put you ahead of most organizations and will give you a foundation to build on as we work through the framework-specific details together.
