It is a fair question, and they are not alone in asking it. Across the region, from SaaS shops in Kingston to fintech startups in Beacon to healthcare platforms operating out of Poughkeepsie, Hudson Valley software companies with even a modest European customer base are waking up to the fact that the EU AI Act has a very long arm. If your product uses AI features and your output reaches people in the European Union, this regulation probably concerns you. The good news is that the Act is structured in tiers, and most SMB SaaS products will not face the heaviest obligations. The bad news is that figuring out where you land requires actual work, and the enforcement timeline is already in motion.
Extraterritorial Scope: Why Your Zip Code Does Not Matter
The EU AI Act follows the same jurisdictional playbook that made GDPR a headache for US companies. Article 2 of the regulation makes the territorial reach explicit: the Act applies to providers of AI systems that are placed on the market or put into service in the Union, regardless of whether those providers are established within the EU or in a third country. It also applies when the output produced by the AI system is used in the Union. That second clause is the one that catches most Hudson Valley firms off guard.
If your SaaS platform includes an AI-driven feature, say a recommendation engine, an automated scoring module, a resume screening tool, or even a chatbot that handles customer queries, and people in the EU interact with that output, you are within scope. You do not need a European office. You do not need a European subsidiary. You need European users. For a region like the Hudson Valley, where software companies often grow internationally through self-service signups and channel partners rather than deliberate geographic expansion, this means the regulation may apply to you before you have given a single thought to EU compliance.
The Risk Classification Pyramid: Where Does Your Product Land?
The EU AI Act does not treat all artificial intelligence the same way. It establishes four risk tiers arranged in a pyramid, and your obligations depend entirely on which tier your AI features fall into. Understanding this classification is the single most important step in your compliance effort, because it determines whether you face a paperwork exercise, a serious engineering commitment, or an outright prohibition.
Unacceptable Risk (Banned)
At the top of the pyramid are AI practices that the EU considers fundamentally incompatible with European values. These are banned outright. The list includes social scoring systems used by governments, real-time remote biometric identification in public spaces for law enforcement (with narrow exceptions), AI that exploits vulnerabilities of specific groups such as children or disabled persons, and systems that use subliminal techniques to materially distort behavior. For most Hudson Valley SaaS companies, this tier is not a concern. You are not building social credit systems. But it is worth knowing the boundary exists, because if a product feature edges anywhere near manipulative design patterns aimed at vulnerable populations, you have a problem that goes beyond compliance.
High-Risk AI
This is the tier that demands the most attention from SaaS providers. High-risk AI systems are those used in specific domains enumerated in Annex III of the Act: employment and worker management (including recruitment tools, task allocation, performance monitoring), access to essential private and public services (credit scoring, insurance pricing, benefit eligibility), education (admissions, grading, proctoring), law enforcement, migration and border control, and critical infrastructure management, among others. If your SaaS product touches any of these domains with an AI feature, even tangentially, you are likely looking at high-risk classification.
For the New Paltz workforce management company I mentioned, this was the uncomfortable realization. Their platform includes an AI module that flags employees for potential attrition risk based on behavioral signals, and another that suggests shift scheduling optimizations. Both of these fall squarely within the employment and worker management category under Annex III. That makes those specific AI features high-risk under the Act, which triggers the full conformity assessment obligation.
Limited Risk
Limited-risk AI systems carry transparency obligations but not the full conformity assessment burden. The primary example is AI systems that interact directly with people, such as chatbots. If your SaaS product includes a chatbot, you must ensure that users are informed they are interacting with an AI system rather than a human. AI-generated content, including deepfakes, also falls here and must be disclosed. For many SMB SaaS products, a customer-facing chatbot or an AI-generated summary feature will land in this tier, requiring disclosure but not the heavyweight documentation of the high-risk category.
Minimal Risk
The base of the pyramid is minimal-risk AI, which covers the majority of AI applications: spam filters, AI-powered search within your product, basic recommendation features that do not influence significant decisions about people. These systems face no specific obligations under the Act, though voluntary codes of conduct are encouraged. If your AI features are limited to things like smart search or content tagging, you can likely breathe easier, but you still need to document that assessment.
Conformity Assessment: What "High-Risk" Actually Requires
If your triage places any AI feature in the high-risk category, the obligations become substantial. The EU AI Act requires providers of high-risk AI systems to implement a quality management system, maintain detailed technical documentation, ensure human oversight capabilities, meet accuracy, robustness, and cybersecurity requirements, conduct a conformity assessment before placing the system on the market, register the system in an EU database, and appoint an authorized representative in the EU if you are a non-EU provider.
The technical documentation requirement alone is significant. You need to describe the intended purpose of the AI system, its design specifications, the data used for training and testing, the metrics used to measure accuracy, the known limitations, and the risk management measures you have applied. This is not a checkbox exercise. It requires your engineering team to produce documentation that an auditor or a market surveillance authority could review and understand. For a fifteen-person company in the Hudson Valley, that is a meaningful investment of time and expertise.
The conformity assessment itself can be conducted internally for most high-risk AI systems (a so-called "self-assessment"), unless the system involves biometric identification, in which case a third-party notified body must be involved. Self-assessment is less expensive than third-party review, but it demands rigor and honesty. You are signing off that your system meets the requirements, and if a market surveillance authority later finds deficiencies, you bear the consequences.
Practical Triage: Is Your AI Feature In Scope?
Before you engage outside counsel or start budgeting for a conformity assessment, take a disciplined internal inventory. The goal of this triage is to answer three questions for every feature in your product that involves any form of automated decision-making or machine learning.
First, does the feature meet the Act's definition of an AI system? The regulation defines this broadly, covering machine learning approaches, logic-based and statistical approaches, and search and optimization methods. If your feature uses a trained model, a decision tree, a neural network, or even a sophisticated rule-based system that adapts based on data, it likely qualifies. A simple if-then rule that a developer hardcoded does not.
Second, does the output of that feature reach people in the EU? This is not about where your servers are. It is about whether a person in Germany or France or any EU member state interacts with or is affected by the AI output. If your platform is available to EU customers and the AI feature is part of the product they use, the answer is yes.
Third, what domain does the feature operate in? Cross-reference the feature against the Annex III categories. Employment decisions, credit assessments, educational evaluations, access to services, law enforcement support: these are the domains that trigger high-risk classification. If the feature operates in one of these domains, you need to plan for conformity assessment. If it does not, check whether it interacts directly with users (limited risk, requiring transparency) or whether it operates in the background without significant impact on individuals (minimal risk).
For the average Hudson Valley SaaS company with a handful of AI features, this triage should take a few focused days of internal review, not months. The key is starting now rather than waiting for an EU customer or partner to force the question.
Enforcement Timeline: The Clock Is Already Running
The EU AI Act entered into force on August 1, 2024, but enforcement is phased. The prohibitions on unacceptable-risk AI practices took effect on February 2, 2025. Obligations related to general-purpose AI models, including transparency and copyright compliance requirements, apply from August 2, 2025. The bulk of the regulation, including the full high-risk AI system requirements and conformity assessments, become enforceable on August 2, 2026. Obligations for high-risk AI systems that are embedded in products covered by existing EU harmonization legislation (such as medical devices or machinery) have a longer runway, with enforcement beginning August 2, 2027.
For a US-based SaaS company with AI features in the employment, finance, or education space, the August 2026 date is the one circled in red. That gives you roughly eight months from the date of this article. Given that conformity assessment requires technical documentation, risk management procedures, data governance practices, and potentially an EU authorized representative, eight months is tight but achievable if you start your triage in January.
Fines: The Deterrent Is Real
The penalty structure follows the GDPR model of scaling fines to company size, but the percentages are steeper. Violations involving prohibited AI practices can result in fines up to 35 million euros or 7 percent of total worldwide annual turnover, whichever is higher. Violations of high-risk AI obligations can reach 15 million euros or 3 percent of global turnover. Supplying incorrect or misleading information to authorities can cost up to 7.5 million euros or 1 percent of turnover. For a Hudson Valley SaaS company doing 5 million dollars in annual revenue, 3 percent is $150,000. That is not an existential threat, but it is a painful line item, and it comes with the reputational damage of a public enforcement action in a market you are trying to grow.
Evidence Pack: What to Build Now
Regardless of where your AI features fall on the risk pyramid, you should begin assembling documentation that demonstrates you have performed a deliberate assessment. The table below outlines the core artifacts, organized by urgency and audience.

The AI System Inventory and the Risk Classification Worksheet are the two artifacts you should complete first, because every subsequent decision depends on them. If your inventory reveals that none of your AI features qualify as high-risk, your compliance burden drops significantly. If it reveals that one or more features do qualify, you will need the conformity documentation, the authorized representative, and the monitoring plan, and you will want to begin those workstreams no later than early 2026.
Bringing It Home
The EU AI Act is not a reason to stop selling to European customers or to strip AI features out of your product. It is a regulatory framework that rewards companies who already practice disciplined engineering: documenting what you build, testing it thoroughly, being transparent with users, and maintaining oversight of automated decisions. Many Hudson Valley SaaS companies are already doing most of this informally. The Act simply requires you to formalize it, write it down, and be prepared to show your work.
The workforce management company in New Paltz is a good example. After our initial conversation, we spent two days building their AI system inventory and running through the risk classification. Two of their seven AI features landed in the high-risk tier. The other five were minimal risk. That clarity allowed them to scope their conformity effort precisely, budget for an EU authorized representative, and respond to their German client's vendor questionnaire with specifics rather than vague assurances. They did not panic, and they did not ignore it. They triaged, planned, and started executing. That is the approach I would recommend for any SaaS company in the region facing the same question.
